A. General

1. Welcome to the Yasmin website.

2. These Terms of Use, together with the "Privacy Policy" document attached to it, govern the terms of use of the site (these Terms of Use and the "Privacy Policy" document and all attachments thereto will be referred to hereinafter collectively and separately as the "Terms of Use" or "Terms of Use").

3. Viewing and using the site are subject to all provisions of the regulations and the law. The surfer/user of the site (hereinafter - "the user") confirms by doing so that he has read all the provisions of the regulations (including their annexes) and that he agrees to them and undertakes to comply with everything stated therein. If you are under the age of 18 or are not entitled to perform legal actions without the permission of a guardian (hereinafter - "minor"), you must read these regulations carefully and carefully together with a parent or other guardian and obtain his permission to perform any activity of any kind within the framework of the site. The parents of a minor or his guardian are responsible for informing the minor who wishes to use the site of the provisions of these regulations and for supervising the minor's activity on the site. 6. The terms of use are written in the masculine form for convenience only, and everything stated therein is intended for both women and men. Likewise, everything stated in the singular form should be read as if it were also stated in the plural, as the case may be, and vice versa.

7. The headings in these Terms of Use are not binding or exhaustive and are intended for the convenience of users only.

8. Wherever in the regulations it says "Yasmin", it is intended to include the operators and managers of the site and/or the Yasmin Customer Club and anyone on its behalf.

9. It is clarified that even if a competent authority determines in the future that any term of these Terms of Use is unenforceable or illegal, the other terms will continue to apply in full.

 

B. Changes to the site and/or Yasmin Customer Club and restriction/discontinuation of service

10. It is clarified that Yasmin may, at her sole discretion, at any time and without the need for any prior notice:

10.1 Block and/or limit viewing and/or use of the Site and/or the Yasmin Customer Club and/or any part thereof in any manner you choose, including making such viewing and/or use conditional on a specific registration process in advance (including, for example, providing the User's identifying information) and/or subscription and/or any other condition and/or procedure you deem appropriate. To the extent that a registration process is conducted in which a username and/or password is received for the purpose of using the Site, the User must keep them confidential to prevent misuse of them and change the password as frequently as possible.

10.2 Prevent any of the users from registering on the site and/or the Yasmin Customer Club (as required) and/or using the site and/or the Yasmin Customer Club and/or the services provided within their framework and/or any part thereof and/or limit them.

10.3 To cease operation of the website and/or the Yasmin Customer Club and/or any part thereof (whether temporarily or permanently).

10.4 Make changes and/or corrections and/or updates to the content of the website and/or its design, as well as delete the content of the website and/or any part thereof.

10.5 To make changes and/or amendments to the policies and terms of the Yasmin Customer Club, including the promotions held within its framework, the benefits provided by virtue of it, the conditions for realizing the benefits, the manner of realizing them, etc. It is clarified that the above is in addition to any right granted to Yasmin in these regulations and/or by law.

 

C. Website content

11. The site contains information and provides services related to Yasmin's products and activities and areas related to this activity, including purchasing through the site, all in accordance with Yasmin's sole discretion. Without derogating from the provisions of these regulations, it is clarified that the site may include estimated information and/or future expectations, etc., and that any such information is uncertain and depends on a wide range of factors. Information provided as a service to the public, such as, but not limited to, surveys, statistics, analyses, assessments, and/or calculators and other aids, is provided without liability for its content, the information should not be considered a recommendation for action, and should not be relied upon without further examination. Therefore, this information should not be relied upon and Yasmin does not make any representation and/or bear any responsibility for it. Yasmin does not bear any responsibility for and/or in connection with the content of the site and/or its use, including within the framework of membership in the Yasmin Customer Club and the actions taken in connection therewith. Yasmin does not make any representation in connection with the correctness of the content of the site and is not responsible for the correctness and/or accuracy and/or timeliness of any information and/or data and/or recommendation and/or suggestion contained therein (including information contained in "User Content", as defined below, and/or publications and/or external sources to which the site contains links, to the extent that they exist, and any information and/or detail and/or data contained on the site in any way and/or derived from it).

13. Yasmin will be entitled to operate and/or allow the inclusion of "User Content" on the Site, as defined in Section 18 below (see details in Sections 18 - 25 below). Without derogating from the provisions of Section 12 above, it is clarified that Yasmin does not bear any responsibility in connection with this User Content and the provisions of Chapter D below will apply to them.

14. Yasmin shall be entitled to include within the framework of the website and/or allow the inclusion of publications and/or offers from third parties as well as links to other websites. Without derogating from the provisions of Section 12 above, it is clarified that Yasmin does not bear any responsibility in connection with these publications and/or links, and the provisions of Chapter 5 below shall apply to them.

15. The site may include various content and financial data about Yasmin, her businesses, etc. However, it is clarified and emphasized that this content may not be up-to-date and/or accurate and therefore should not be relied upon, and Yasmin does not make any representation and/or bear any responsibility regarding them.

17. It is emphasized again that Yasmin is entitled to make changes and/or corrections and/or updates to the content of the website and/or its design at any time (see Section 10.4 above).

 

D. User Content

18. Jasmine may operate within the framework of the Site, at its sole discretion, various communication channels that will allow users to express an opinion and/or respond and/or answer questions and surveys and/or submit questions and/or upload and/or publish information, as well as participate in any way in the content of the Site (such as within the framework of chats, blogs, forums, etc.) (hereinafter - "User Content"). It is clarified that Jasmine is not obligated to publish User Content on the Site (whether in general or specific content) and that their publication will be done at the sole discretion of Jasmine, including with regard to the manner of their presentation, their location, the duration of time for which they will be displayed, etc.

19. To the extent that user content is included on the site, Yasmin will be entitled, at its sole discretion, to reject and/or remove and/or change the user content or any part of it (whether before or after its publication).

20. It is clarified that Yasmin is not responsible for including the surfers' content (including its truthfulness, reliability, up-to-dateness, etc.) and that what is stated therein does not express Yasmin's position. It is also clarified that the publication of the surfers' content within the framework of the site and/or the failure to publish it and/or the failure to remove it from the site does not impose any liability on Yasmin for it.

21. A user who uploads or publishes user content on his behalf to the website in any way (including via e-mail, etc.) declares that he owns all rights to it and its contents and all attachments on his behalf (including a photo, photograph, illustration, etc.) or that he holds legal permission from the rights holder to use it in any way and grant any right to it, and that the publication of user content on his behalf and/or its use does not violate and/or harm the intellectual property rights or any other rights of a third party. Such user waives any right he has in the user content uploaded/transferred on his behalf and agrees that Yasmin will be entitled to use such content and any idea and/or knowledge and/or information contained therein and/or derived from it in any way it chooses and for any purpose, as well as to copy, distribute and publish it in any way and in any way it chooses (whether in Israel or abroad), whether by itself or by authorizing others, all without time limit and without compensation.

22. Yasmin shall be entitled to retain and use any information requested by it and provided to it by users in a manner consistent with its privacy policy. Any other information transmitted to Yasmin or uploaded to the Site (not at Yasmin's request) shall be deemed non-confidential and Yasmin shall be entitled to publish it or use it in any other manner (see Section 21 above).

23. Yasmin takes information security measures to secure the information contained on the site and/or transmitted within its framework, however, despite the aforementioned, there may be failures in the security of the aforementioned information (such as interception, unauthorized access, etc.). Yasmin does not undertake to completely secure the information contained on the site and/or information transmitted by users within the framework of and/or for the purpose of its use (such as information contained in user content, user details provided as part of the registration process for the site, if any, etc.). By uploading user content to the site by a user and/or providing any information or data by him within the framework of using the site, he confirms that he is aware of the aforementioned and that he will not have any claim and/or demand against Yasmin in respect of the aforementioned.

24. The user undertakes not to publish and/or upload and/or display on the site in any way and in any framework any information and/or position and/or software and/or content (including a picture, photograph, illustration, etc.) that is false and/or offensive and/or misleading and/or constitutes an injury to the public's feelings or beliefs and/or that contains or contains content that constitutes defamation and/or that is illegal and/or encourages illegal action and/or that is not appropriate for publication for any reason (such as content of a sexual nature, racist content, incitement, threats, etc.), and not to upload advertising material that is not Yasmin's. Without derogating from the above, the user undertakes not to upload to the site any information and/or software and/or content whose publication by him constitutes a violation of copyright or any other rights of a third party (including the right to privacy). Users are solely responsible for content uploaded by them and/or on their behalf to the website.

25. For the avoidance of doubt, it is clarified that users are not permitted to use surfer content published on the site, even if it is exposed to view, unless Yasmin's prior written consent has been given.

 

E. Links and publications on the site

26. The Site may contain links to other sites on the Internet for the convenience of users. It is clarified that Yasmin does not control or supervise the content on the aforementioned sites and/or the use of those sites (including their terms of use and privacy policy) and therefore does not bear any responsibility in connection with the content and/or use of the aforementioned sites. The fact that the Site links to these contents does not indicate Yasmin's consent to their content and does not constitute a guarantee of their reliability, up-to-dateness, legality, privacy protection procedures and/or any other aspect in connection with the aforementioned, and does not impose any responsibility on Yasmin for them. Furthermore, Yasmin does not guarantee that the links found on the Site will be correct and will lead to an active website. Yasmin may remove links from the Site that were previously included in it, add new links or refrain from adding such links, all at its sole discretion.

27. The site may contain advertisements and/or offers from third parties. It is clarified that Yasmin is not responsible for these advertisements and/or offers and the sole liability for them (including for misleading, harmful advertising, etc.) applies to the advertisers and offerors themselves.

28. The site must not be linked to any site that contains content that offends the public's feelings and/or beliefs and/or that is or its advertising is illegal or encourages illegal activity (such as pornographic content, content that encourages racism or illegal discrimination, content that constitutes slander, content that contains threats, etc.).

29. You may not link to content from the Site that is not the Site's home page ("deep link"), and you may not display or publish such content in any other way, unless the deep link is to a web page on the Site in its entirety and as is (AS IS) so that it can be viewed and used in a manner completely identical to its use and viewing on the Site. Within the framework of the above, it is prohibited to link to content from the Site separately from the web pages on which they appear on the Site (for example, you may not link directly to an image or graphic file on the Site, but rather to the full page on which they appear). In addition, the exact address of the web page on the Site must appear in the usual place designated for this purpose in the user interface. This address must not be changed, distorted, or hidden, and it must not be replaced with any other address.

30. The user agrees that Yasmin may instruct him to remove any link to the site at her sole discretion.

 

G. Use of the website

31. The site may not be used for commercial purposes unless prior written permission is received from Yasmin.

32. The site may not be used for illegal purposes (including within the framework of uploading user content in a manner contrary to the provisions of these regulations).

33. The contents of the website and/or any part thereof may not be copied and/or reproduced and/or transferred to another and/or broadcast and/or published. The contents of the website may not be used and/or allowed to be used by others, except for the purpose for which they were published.

34. The site and/or its contents and/or any part thereof may not be displayed in any way, including through any software, device, accessory or communication protocol, that changes the design of the site and/or its contents and/or removes anything from them (including advertisements and commercial content).

35. The website and/or its contents and/or any part thereof (including the website name and/or its Internet address) may not be displayed within another website (including displaying content within a frame).

36. You may not activate or allow the activation of any computer application or any other means (including software such as Crawlers, Robots, etc.) for the purpose of searching, scanning, copying or automatically retrieving content from the Site. In this regard, you may not create or use such means for the purpose of creating a collection, compilation or repository containing content from the Site.

37. User content may not be uploaded to the website in violation of the provisions of Section 24 above.

38. No link may be made to the Site in violation of the provisions of Sections 28 - 29 above.

39. Do not harm in any way the use of other users of the site (including for the purpose of uploading user content).

40. You must not harm and/or interfere with the use of the site and/or the information published on the site and/or its servers (such as by interception).

41. Do not attempt to circumvent and/or damage any security software on the site.

42. The site and/or any part thereof may not be used for the purpose of hacking into any computer systems (including those of the site itself) and/or scanning ports and/or distributing a computer virus or any other harmful software and/or distributing chain letters and/or using the site for any purpose whose primary purpose is to overload the site's computer systems and/or prevent or harm the use of the site and/or any other website and/or any other use that harms the site and/or its users and/or any third parties.

43. By doing so, the user agrees to the provisions contained in this chapter above and undertakes to act in accordance with them and all provisions of the regulations and in accordance with any law. It is clarified that Yasmin may immediately prevent a user who violates any of the provisions of these regulations from using the site and take against him any remedy granted to it by law (including providing relevant information to the competent authorities).

 

H. Purchases through the website

44. Making purchases through the site will be possible subject to fulfilling the cumulative conditions detailed below:

44.1 The user is an adult (18 years of age or older) or a corporation legally incorporated under the laws of the State of Israel.

44.2 The user has an active email account on the Internet.

44.3 The user holds a valid Israeli or international credit card, issued by one of the recognized credit card companies, and the credit card company has approved the transaction. It is clarified that Yasmin reserves the right not to accept various types of credit cards.

44.4 The requested products are in stock.

45. When making a transaction on the site, the user will be required to enter the following details in the registration interface: ID card, first name, last name (company name and number - as applicable), telephone number, address, zip code, e-mail and payment method details. It may be necessary to enter additional details, as appears on the site. The user confirms that the details entered are correct, complete and accurate, and agrees that the provision of personal details during the order is done according to his wishes and with his consent.

46. ​​To the extent that the details provided are incorrect, inaccurate or incomplete, Yasmin will not be able to guarantee the execution of the order. It is the user's responsibility to ensure that all details entered by him are correct and have been fully recorded. Without derogating from the foregoing, the user declares and confirms that he is aware that knowingly providing false details may constitute a criminal offense and that civil and criminal legal measures may be taken against those who provide false details, including claims for damages caused to Yasmin as a result.

47. By actually carrying out the transaction, the user declares that the card through which the transaction is carried out belongs to him, or to the corporation on whose behalf he is carrying out the transaction, that the card is valid and that he is authorized under any law and/or agreement with the credit card issuer to carry out a transaction for the relevant transaction amount.

48. The sale on the site is a sale at a fixed price in advance until the stock runs out (regular sale). In the event that after the sale of a product, it becomes apparent that the product is out of stock, due to circumstances that were not known at the time of the order, Yasmin will notify the consumer within one business day and allow him to choose between ordering a replacement product or canceling the transaction.

49. Payment for the transaction will be made by credit card or PayPal.

50. The user will provide personal details as stated in Section 45 above, after which the user will confirm the execution of his order (hereinafter - "the order").

51. After placing the order, Yasmin will check the credit card details with the appropriate credit company and upon receiving the credit company's approval, an email will be sent to the user, in accordance with the details he provided. It is clarified and emphasized that the transaction will be finalized only after Yasmin receives the credit company's approval of the payment, in accordance with the procedures agreed upon between it and the relevant credit company, and subject to the product being in stock, as stated in Section 48 above. It is also clarified that Yasmin is entitled not to accept payment by credit cards of various types, in accordance with Yasmin's discretion. To the extent that the transaction is not approved by the credit company or Yasmin does not accept the user's type of credit card, a message will be displayed to the user on the site or a notification will be sent to the user by email to that effect. It is clarified that in such a case, the order will be considered as not having been placed.

52. The order's shipping dates will be counted from the date the transaction is approved by the credit card company.

53. The user declares that by providing the email address, he approves the sending of messages by Yasmin in connection with the execution of orders in accordance with the details provided by him. It is clarified and emphasized that the sending of the aforementioned email message does not constitute evidence of the execution of the action.

54. The internal computer records of Yasmin and/or someone on her behalf will constitute admissible evidence of the execution of the order as aforesaid.

55. The delivery of products purchased through the website is detailed below:

55.1 Yasmin will deliver the products purchased through the website to the address in Israel that the user specifies when ordering and subject to the provisions of section 44.5 above.

55.2 Shipping services will be through the courier company chosen by Yasmin and in accordance with her discretion.

55.3 Yasmin will act to deliver the products according to the stated terms and shipping prices stated below:

55.4 Yasmin undertakes to only deliver products for which the consideration has been paid in full using the user's credit card and to the address specified by the user.

55.5 Payment for the shipment will be made via credit card and will be included in the payment for the products, and will not be able to be canceled for any reason, except if the transaction was canceled due to a defect or incompatibility, or if the transaction was canceled before the shipment was made.

55.6 The delivery date of the products indicated on the site, with respect to each product, refers to the working days of the courier company used by Yasmin at the time of purchase of the product (excluding Fridays and Saturdays, holiday eves and holidays), with their counting beginning on the day of receipt of the credit company's approval of the transaction. An order placed after 12:00 will be considered, for the purpose of the delivery date, as an order placed on the next working day.

55.7 Yasmin will not be responsible for any delay in delivery and/or non-delivery that may result from incorrect and/or inaccurate and incomplete details provided by the user or that were not fully captured by the system. It is the user's responsibility to ensure that all details entered by him are correct and fully captured. Without derogating from the foregoing, the user must ensure that he has entered a current and available telephone number for the purpose of contacting the courier company. If it is not possible to contact the user using the telephone number provided within a reasonable time or if the delivery cannot be carried out due to a defect in entering/capturing the user's details, Yasmin will not be responsible for any delay and/or non-delivery that may result from the connection.

55.8 In the event that the user requests to leave the products he purchased through the Site at the door of his house or in the electrical cabinet, Yasmin will not be responsible for any damage and/or loss of any kind that may be caused to the products and/or the user as a result. It should be emphasized that a user who requests that the products he purchased through the Site be left at the door or in the electrical cabinet as aforesaid does so at his full and exclusive risk and no claim and/or demand and/or claim will be heard against Yasmin and/or the shipping company regarding the aforementioned, including but not limited to, in the event of theft of the products or damage to the products.

55.9 Yasmin will not be responsible for any delay or delay in delivery and/or non-delivery caused by force majeure and/or events beyond its control, including strikes, Sabbaths, etc.

55.10 In the event of a delay or delay in delivery known to Yasmin in advance, Yasmin will make every effort to inform the customer in advance of the expected delay or delay, in accordance with the contract details provided by the customer at the time of purchase. 56. Transaction Cancellation Transaction cancellation by the user

56.1 The user will be entitled to cancel the transaction in accordance with and subject to all provisions of the law, including the provisions of the Consumer Protection Law, 5741 – 1981 (hereinafter - the "Consumer Protection Law") and the regulations thereunder.

56.2 Below is a breakdown of the main terms and conditions and the way in which the user can cancel the purchase transaction he made:

56.2.1 The user may cancel the transaction to purchase the product 14 days from the date of receipt of the product or from the date of receipt of the transaction details, whichever is later;

In accordance with the Consumer Protection Law, cancellation of a transaction conducted with a consumer/user who is a person with a disability, a veteran citizen or a new immigrant (hereinafter: "the consumer"), will be possible within four months from the date of making the transaction, or from the date of receiving the property, or from the date of receiving the document containing the details stated in Section 14C(b) of the Consumer Protection Law, as the case may be, whichever is later, provided that the engagement in the transaction included a conversation between Yasmin and the consumer, including a conversation via electronic communication. In such a case, Yasmin will be entitled to require the consumer to present an appropriate certificate.

56.2.2 The user is not entitled to cancel a transaction for the purchase of the following products: A. perishable goods; B. goods that were specially manufactured for the consumer following the transaction; C. goods that can be recorded, reproduced or duplicated, the original packaging of which the consumer has opened.

56.3 Cancellation of a transaction carried out on the website will be canceled in accordance with the provisions and terms of the Consumer Protection Law by contacting Yasmin in any of the following ways:

56.3.1 The user who requests to cancel a transaction carried out on the website will provide Yasmin with his full name and ID number, and details of the transaction he requests to cancel, and if a verbal notification was provided - additional identifying information at Yasmin's request.

56.4 After receiving the notice of cancellation of the transaction as stated above, Yasmin will refund to the user, within 14 days of receiving the notice of cancellation of the transaction, that part of the transaction price that was paid by him, and will not charge the user any amount, except for cancellation fees at a rate not exceeding 5% of the product price or 100 new shekels, whichever is lower (in the event of cancellation of a transaction due to a defect, inconsistency between the product and the details on the site or the details provided in the purchase document, failure to deliver on the specified date or due to any other breach of the contract, no cancellation fees will be charged).

56.4.1 In accordance with the Consumer Protection Law, cancellation fees also include shipping costs, packaging and any other expenses and obligations of Yasmin due to her entering into a transaction or its cancellation.

56.4.2 Yasmin informs the user that, in accordance with the provisions of Section 14E(c) of the Consumer Protection Law, Yasmin may claim damages from the user due to the decrease in the value of the product as a result of a significant deterioration in its condition.

56.5 If the person performing the action received the product before the transaction was canceled by him, he will arrange for the product to be returned to Yasmin, at his expense, in accordance with the details provided to him (in the event of cancellation of the transaction due to a defect or non-conformity, the return of the property to Yasmin will be at her expense). The product will be returned, to the extent possible or reasonable, in its original packaging.

57. Cancellation of the transaction by Yasmin

57.1 Yasmin may cancel a transaction in whole or in part in the following cases:

57.1.1 In the event that the offer contains an unusual and obvious typographical error on its face, whether in the price of the product or in the product description;

57.1.2 If it is discovered that a communication failure and/or other technical problem has occurred that prevented users from being able to continue and participate in the sale properly;

57.1.3 In the event of force majeure, acts of war, hostility or terrorism that prevent the continuation of the sale, its execution or participation in the sale in a proper manner;

57.1.4 If it becomes clear to it that the transaction and/or sale was accompanied by illegal activity by the user and/or someone on his behalf;

57.2 Notice of cancellation of the sale will be given to the customer by telephone and/or in writing to the address specified by the customer when making the transaction or when registering on the site. In this case, the transaction will be canceled and Yasmin will refrain from charging the user's credit card or refund any amount paid for the product, to the extent paid.

57.3 Except for the refund of the transaction amount as stated, the user will not have any claim, claim and/or demand, of any kind, against Yasmin for the cancellation of the transaction as stated in this section.

58. Liability policies

59. Yasmin provides a warranty for the products it markets. The warranty periods are as follows:

60. Three months warranty for each piece of jewelry.

61. The warranty is provided for cases of manufacturing defects that are discovered during reasonable use of the product, and will be given to any customer who presents a document as proof of purchase.

 

I. Privacy Policy

62. Yasmin understands the importance of the privacy of site visitors and respects their privacy when using the site. Yasmin's privacy policy with respect to this site is detailed in Yasmin's "Privacy Policy" appendix attached to these Terms and Conditions and appearing on the site (hereinafter - the "Privacy Policy") and constitutes an integral part of these Terms and Conditions. By using the site, the user also agrees to the content of the Privacy Policy (you must be updated on changes to the Privacy Policy from time to time). The Privacy Policy will apply to the personal information actively provided by the user for the purpose of registering for the Yasmin Customer Club in accordance with Yasmin's requirement.

63. Any other information collected by Yasmin and/or received by it regarding the user (which is not personal information actively entered by the user - subject to the privacy policy, except for information subject to the privacy policy or a separate express agreement between Yasmin and the user) as well as any message, material or content sent or uploaded to this site via e-mail or otherwise, including data, questions, responses, suggestions, etc., will be considered non-confidential information and not protected by any rights, will not be subject to privacy protection, and will be treated accordingly. Any content transmitted or uploaded to the site becomes the property of Yasmin, which will be entitled to reproduce, publish, disclose, broadcast, upload it to the site or use this information in any other way, for any purpose.

 

J. Intellectual Property

64. All copyrights and intellectual property rights in the site and/or in its design and/or in the services provided within its framework and/or within the framework of the Yasmin Customer Club and/or in the software/applications/computer code/graphic files, etc. contained therein and/or in the trademarks contained therein and/or in its name and/or its domain name and/or in all other content therein and in everything contained therein (hereinafter - the "Protected Material") belong solely to Yasmin (or to other third parties who have authorized Yasmin to use them, such as business partners).

65. You may not copy, publish, distribute, publicly display, broadcast, transfer to a third party or the public or make available to them, process, modify, create or make derivative works, sell or rent the protected material or any part of it, whether independently or through or in collaboration with a third party, in any way or means (including electronic, computerized, mechanical, optical, photographic or recording means, etc.) and/or violate the intellectual property rights of Yasmin and/or the site management and/or any third party whose intellectual property is displayed and/or appears on the site, without obtaining Yasmin's prior written consent and subject to the terms of the consent (to the extent given).

66. It is clarified that the publication and/or inclusion of material on the site and/or the user's use thereof does not grant the user any right whatsoever in the protected material (including any license, trademark, patent and any other proprietary right).

 

K. Limitation of Liability

67. Yasmin does not bear any responsibility for and/or in connection with the content of the site and is not responsible for the correctness and/or accuracy and/or timeliness of any information and/or data and/or recommendation and/or suggestion contained therein, including information contained in "User Content" and/or publications and/or external sources to which the site contains a link and any information and/or detail and/or data contained on the site in any way and/or derived from it (see also sections 11 - 15 above). It is emphasized again that all information and data appearing on the site are general and are included therein for the convenience and enrichment of users only. In addition, the site may include information that is not accurate or up-to-date and the user must check and verify the correctness and timeliness of the information before making any use of it.

Yasmin is not responsible for any failure and/or malfunction and/or defect in the operation of the site and/or viewing and/or use thereof and/or in the Internet and/or communications services, etc. Without derogating from the above, Yasmin is not responsible for any failure and/or malfunction and/or defect in the use of the site in the context of exercising membership in the Yasmin Customer Club, including in registering for the Yasmin Customer Club (such as failure to accurately and completely record the details provided by users) and/or in exercising the benefits provided in the Yasmin Customer Club (such as failure to record the codes entered by the user in accordance with the instructions on the site, etc.) and/or in everything related to the use of the Yasmin Customer Club within the context of the site (and Yasmin is not responsible for defects in exercising membership in the Yasmin Customer Club through the site or any platform on which the exercise of said membership is possible).

69. Yasmin will not be responsible for any damage that may result from inappropriate or incorrect use of the products. The images on the site are for illustrative purposes only. It should be emphasized that there may be differences in color or other changes between the appearance of the product in the image and the product in reality.

71. In any case where it is proven that Yasmin's negligence prevented the user from using the site and/or the Yasmin customer club and/or receiving any benefit and/or making a purchase on the site, the compensation will be limited to the amount of the cost of the telephone call and/or the cost of browsing that the user made (if he made it) in order to realize the benefit/purchase and not beyond that, unless Yasmin decides otherwise, at its sole discretion.

72. Without derogating from the provisions of these regulations, it is clarified that in the event of any malfunction that interferes with the proper conduct of the site, Yasmin will be given full discretion to decide whether she wishes to cancel or change or perform any other action in connection with the site.

73. Yasmin is not responsible for damages that may be caused to users and/or third parties as a result of the use of the site and/or the inability to use it, including due to software included on the site or whose activation results from the use of it and/or on sites to which there are links on the site (such as viruses) and/or for any other damage that may be caused due to and/or in connection with the site and/or its use, even if there is negligence on Yasmin's part, or if it became aware of the possibility of such damages.

75. The user undertakes to hold Yasmin and/or anyone on her behalf liable for any damage, loss or expense incurred by her (including legal expenses) due to his violation of the terms of use and/or the law.

12. Applicable law and jurisdiction

76. The law applicable to and in connection with these Terms of Use and the use of the Site is Israeli law only (whether the use of the Site is made in Israel or abroad).

77. Exclusive jurisdiction in connection with the Terms of Use and the use of the Site is vested in the competent court in Tel Aviv-Yafo only.

13. Miscellaneous

78. The user agrees that the transmission of information to or from the site does not create any connection and/or relationship between him and Yasmin that goes beyond those specified in these regulations.
